AI Policy
This policy outlines AI use when working with me in the mediation process. The aim of the policy is to help clients, professionals and any third parties involved in the mediation process understand what is allowed, what is not and how I manage the use of AI responsibly and securely. The goal is to support secure and ethical use of AI if expressly agreed to meet your needs, while minimizing risks.
Clare Madeline Mediation’s use of AI
AI is an incredibly fast moving development that offers smarter ways of working but it also raises ethical, environmental, data privacy and confidentiality issues. I run a bespoke, mediation practice and whilst I want to make use of any technology that makes your mediation process run smoother for you, we do not currently know enough in the world of family mediation about AI within the mediation process for me to confidently guarantee what is crucial to mediation – confidentiality.
I do not use AI during your confidential mediation process in order to protect your data privacy and ensure confidentiality at all times. AI may be used by Clare Madeline Mediation generically for marketing purposes and on my social media channels but it is not used within the mediation process, which includes the production of any/all client documentation or anything related to your confidential mediation process.
This policy outlines the guidelines for AI in mediation with me. This policy applies to all mediators, participants in mediation, and any professionals (or non-professional support people) involved in the family mediation process.
Your use of AI during mediation
For the mediation process during any session (MIAM or mediation meeting) and throughout the process, I ask that no one records or transcribes a mediation meeting and no form of AI or recording should be used and this also includes not putting anyone’s private information or sharing any documents produced in mediation into an open AI.
Use of AI for your own purposes to help you in mediation is something which needs to be discussed and expressly agreed in advance (which will also involve agreement of the other party involved in your mediation and any other professionals).
If you use an AI system to help you outside of your mediation meetings, I will need to understand how you wish to use AI to support you, why and what AI system you intend to use. This must be expressly agreed before any MIAM or mediation meeting progresses and you must commit to the following:-
- You will not audio or video record a mediation meeting in line with the terms set out in the Agreement to Mediate. This practice conflicts with the principles of confidentiality that underpin mediation, whereby clients are afforded a protected, safe space to explore options and speak openly without fear of being bound by a fixed record and undermines the very foundation of mediation.
- You will not use any AI tool in a mediation meeting to generate any transcripts of mediation sessions or in gathering information that is shared as part of the mediation process.
- You will not share any personal identifiable information. Publicly available AI tools should never be used to process sensitive information or anything shared in mediation by any party (mediation, other professional or any mediation participant).
- Information shared during mediation will be treated as strictly confidential and will not be disclosed to unauthorised parties or AI tool.
- The AI system used must comply with relevant data protection regulations (e.g. GDPR) to safeguard personal information.
Enforcement
Please notify me in writing immediately of any breaches to clare@claremadelinemediation.co.uk
Failure to comply with this policy will result in termination of mediation and in the event of a mediator breach a referral to the Family Mediation Council, depending on the severity of the breach. A referral to the Information Commissioner’s Office may also need to be made.
Review
This policy was put into place in October 2026. I will review this policy at least annually and updated as necessary to reflect technological developments, changes in applicable laws, regulatory guidance and to ensure I keep up to date with any regulatory changes with my supervisory body, industry best practices and take into account your feedback and any requests for the use of AI.
Conclusion
I want to maintain the highest standards of confidentiality, privacy and ethical conduct and this policy is implemented to ensure that this is prioritised. I adopt a cautious approach to the use of AI in mediation on this basis.
